A temporary custody order is non-prejudicial to the permanent custody determination, however, the custodial schedule set forth will create a “status quo” for which good reason will have to be provided to the judge at a permanent hearing why that should be changed.
In North Carolina, emergency custody may be requested and granted even prior to service of a Custody Complaint if the court finds that the child involved is exposed to a substantial risk of bodily injury or sexual abuse or that there is a substantial risk that the child may be abducted or removed from the State of North Carolina for the purpose of evading the jurisdiction of North Carolina.
